The Care to Know PRO database is operated by and for Patient MediQuest, a Canadian corporation (“Patient MediQuest”). We provide healthcare education and the opportunity for you to request and receive information, content and/or media (collectively, “Information”) on a variety of healthcare topics and medical conditions that are of interest to you.

The terms set out below (“Terms of Use”) identify what you, as a user of the Care to Know PRO database (the “Database”), can expect from us and what we in turn expect from you. By visiting or using any area on or component of the Database, you are subject to these Terms of Use and are deemed to have accepted them. If you do not consent to be bound by these Terms of Use, please do not visit or use this Database and leave it immediately.

  1. Prohibited Activities. This Database is for your personal, non-commercial use. Access by you to the Database is subject to you not doing the activities set out below (the “Prohibited Activities”), which are expressly prohibited. You shall not
    1. modify, download, reproduce, copy, resell or commercially use the Database, the content or any portion or derivative thereof;
    2. enable high volume, automated, electronic processes that apply to the Database or its systems, the content or any portion or derivative thereof;
    3. use any robot, spider, data-miner, crawler, scraper or other automated means to access or index the Database or its systems, the content or any portion or any derivative thereof for any purpose;
    4. interfere, impede or attempt to interfere with the proper working of the Database;
    5. frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout or form) of Patient MediQuest;
    6. use Patient MediQuest’s name, trademarks, service marks or logos in any meta tags or any other “hidden text”;
    7. compile, decompile, reverse engineer, repackage or disseminate any code from the Database;
    8. spoof or use the Patient MediQuest’s name to perform spamming, phishing, social engineering or impersonation of any type;
    9. attempt to upload any malicious content, materials or files to the Database or users of the Database; or
    10. perform any type of Database penetration testing or load testing of any means.
  2. Confidentiality and Privacy. Any personal information on the Database shall be treated in accordance with the Patient MediQuest Privacy Policy.
  3. Compliance with Laws. Your usage of the Database is subject to all applicable laws and regulations, and you agree not to violate such laws and regulations.
  4. Modification. Patient MediQuest reserves the right to make changes to the Database, including posted policies, and these Terms of Use at any time without notice or liability. A user’s continued use of the Database shall constitute acceptance of any modifications to this Database and the Terms of Use.
  5. Intellectual Property Rights. Patient MediQuest retains all right, title and interest in and to the Database, including all copyrights, patents, trade secrets, trademarks and other intellectual property rights.
  6. Termination. Patient MediQuest may issue a warning, suspend or terminate any user’s right to use or access all or any part of the Database, without notice, if they breach any term of these Terms of Use or if Patient MediQuest reasonably believes that such access would violate any applicable law or would be harmful to the interests of, or potentially cause financial loss or legal liability to, Patient MediQuest or any other user, person or entity.
  7. Jurisdiction. You agree that the Database shall be deemed solely based in Ontario, Canada. The validity, interpretation and enforcement of these Terms of Use shall be governed exclusively by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. You agree that any cause of action in relation to the Database must be commenced within one (1) year after the cause of action accrues or such cause of action is permanently barred. Patient MediQuest makes no claims, representations or warranties that the Database, any links to third-party websites or any Information are appropriate or may be downloaded outside of Canada. Access to and use of the Database and the access, download or receipt of any Information may not be legal by certain persons or in certain countries or other jurisdictions. If you access the Database from outside of Canada, you acknowledge and agree to do so at your own risk and are solely responsible for your compliance with the laws, regulations and guidelines of that jurisdiction.
  8. Disclaimer. This Database does not provide medical advice of any kind. Patient MediQuest assumes no liability for and makes no representations or warranties whatsoever in respect of any Information ultimately provided or delivered to you, including but not limited to the accuracy, suitability, usefulness, appropriateness, relevance, safety, currency or timeliness of the Information. You understand and acknowledge that you may be exposed to Information that is inaccurate, offensive, indecent or objectionable. Your use of this Database, its content and any Information, services or items accessed, received, viewed, or downloaded through the Database is at your own risk. You acknowledge and agree that the Database, its content and any Information, services or items accessed, received, viewed or downloaded through the database are provided on an “AS IS” and “AS AVAILABLE” basis by way of electronic mail, website link, PDF attachment, access to the Database library and archive, or by other means used by Patient MediQuest from time to time, without any warranties of any kind, either expressed or implied. Additionally, you acknowledge and agree that Patient MediQuest does not guarantee or make any representations or warranties in respect of the delivery of the Information or your ability to view, access or download the Information, and you agree that you are solely responsible for possessing any technology (whether hardware or software) or equipment required to view, receive, access or download the Information. In no event shall Patient MediQuest, its officers, directors, employees or agents be liable to you for any direct, indirect, incidental, special, punitive or consequential damages resulting from any claim, injury or damage incurred by you from your use of the Database or any Information you access or receive. You agree to defend, indemnify and hold Patient MediQuest, its officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from (i) your use and access of the Database and any Information provided or delivered; (ii) your violation of any aspect of these Terms of Use; or (iii) your violation of any third-party right, including without limitation to any copyright, property or privacy right.
  9. Links. The Database may contain links to third-party websites. Without limiting paragraph 8 above, Patient MediQuest assumes no responsibility for any third-party websites and the content and information thereof, and you agree that your use of third-party websites is at your own risk, including bugs, viruses or other problems which may be transmitted to or through such websites. As a user of the Database and its services, you expressly discharge Patient MediQuest from any and all liability arising from any links to third-party websites or downloads.
  10. Advertising. You acknowledge and agree that the Database, any links to third-party websites, and any Information you access or receive may contain advertisements or may be considered advertising pursuant to the relevant laws, regulations or guidelines. Patient MediQuest assumes no liability for and makes no representations or warranties whatsoever in respect of such advertisements and any non-compliance or violation of advertising or marketing laws, regulations and guidelines arising therefrom. Patient MediQuest does not endorse and is not responsible for any product or service advertised or offered by a third party through the Database, any link on the Database, or any Information you access or receive.
  11. General. You hereby certify that you are at least 18 years of age and are a healthcare service provider with the capacity to understand, accept and comply with these Terms of Use.
